Living under a protective order when you share children

A Utah cohabitant abuse protective order can give one parent temporary custody and set, supervise, or deny the other parent's parent-time, and its no-contact term can carry exceptions only for the parent-time the order itself spells out. Those family terms expire after 150 days unless extended. Lasting custody and parent-time are decided in a divorce, custody, or parentage case, not in the protective order.

A protective order is simple when two people can simply stop seeing each other. It is not simple when they have children. School pickups, a sick kid, a question about a permission slip: each one is a moment where the order and ordinary parenting collide. This guide is about how Utah handles that overlap, and where to take the questions the order does not answer.

If you are in danger right now, call 911. The Utah Domestic Violence Coalition's LINKLine is free, confidential, and open 24 hours: call or text 1-800-897-5465.

Last checked: October 19, 2026, against Utah Code Title 78B, Chapter 7, and the Utah Courts' self-help pages. This is general information, not legal advice. Decisions about children under a protective order are exactly the ones to take to an attorney.

What the order can say about the children

When the court issues a temporary cohabitant abuse order, it can award one parent temporary custody of a minor child and appoint a guardian ad litem. The no-contact term in that temporary order bars direct and indirect contact "with the exception of any parent-time provisions in the ex parte order." So any contact for parent-time has to be written into the order. Nothing is implied.

After notice and a hearing, the court can go further. It can specify arrangements for the respondent's parent-time, require that a third party supervise it, or deny it entirely if necessary to protect the safety of the petitioner or the child.

If the order comes from a civil stalking injunction instead, and you have children together, the law directs the court to follow the cohabitant order rules and to take the respondent's custody and parent-time rights into account while keeping the victim and the children safe.

In a criminal case, a pretrial protective order can name a person chosen by the victim to carry communication between the parties for family matters, and can allow indirect or limited contact to arrange visits with a shared child. Those terms are set by the criminal court, not by agreement.

These terms are temporary

The custody and parent-time provisions of a cohabitant order are civil provisions. By statute they expire 150 days after the order is entered unless the court finds good cause to extend them, and even an extension cannot run past three years without a separate motion. The no-contact and stay-away terms last the full three years.

That gap is deliberate. A protective order is a safety tool. Lasting decisions about where children live and how parent-time runs are made in a divorce, custody, or parentage case, with the fuller process those cases involve. If such a case is already pending between you, that court can dismiss or modify the protective order's civil terms, including custody, if you both stipulate or it finds good cause.

Utah law also says that when a protective order proceeding between parents involves custody, the court must apply the custody standards used in family cases. If you are the one asking for temporary custody, expect the court to look at the same factors a family court would.

Exchanges, messages, and the daily reality

Exchanges. Do them only the way the order allows. If the order sets supervised parent-time or a third-party exchange, use the person or place it names. If it allows parent-time but says nothing about how the children move between homes, ask the court to specify before the first exchange. Guessing creates a violation on one side and fear on the other.

Messages about the children. A no-contact term covers messages about the kids too, unless the order carves out an exception. Many orders route communication through a third party or a court-approved channel. If yours does not say, do not assume a text about a dentist appointment is allowed. Ask your attorney or the court.

Schools and activities. The order may bar the respondent from the child's school. If it does, the school needs a copy. If it does not, and both parents attend the same event, the stay-away distance still applies.

Emergencies. If a child is hurt or in danger, call 911 first. Tell your attorney afterward so that any contact that happened is on the record with its reason.

Required classes. If a divorce is filed, Utah requires both parents of minor children to complete the divorce orientation and parenting classes. The classes are taken separately, and taking them does not involve contact with the other parent.

Where the lasting decisions get made

A divorce or custody case will set permanent custody, parent-time, and support. Utah requires at least one mediation session in a contested divorce, and that requirement can be excused for good cause. The courts give not feeling safe as an example of good cause, but no source makes the excusal automatic, so you or your attorney need to ask. Our guide on mediation when there is a protective order covers that step and what the law does and does not allow.

If mediation does go ahead with the court's blessing and safeguards, the parenting questions are the ones most worth settling by agreement, because an agreement you helped write is more likely to work day to day than one imposed on both of you.

If you want to mediate parenting logistics with a protective order in place, the only path is through the court, in writing, before any contact happens. Salt City Mediation mediates between two people under a protective order only when the order itself, or a later court order, expressly allows that contact, and we need a copy first. Without it, we can work with one parent alone to prepare for the court process.

Common questions

Can the other parent still see the kids if I have a protective order?

That depends on what the order says. After a hearing, the court can set arrangements for the respondent's parent-time, require a third party to supervise it, or deny it where necessary to protect you or the children. The no-contact term can include an exception only for parent-time the order spells out. If the order is silent, assume contact is barred and ask the court.

How do we exchange the kids with a no-contact order?

Only in the way the order allows. Common arrangements the court may write in are exchanges through a third party, at a supervised exchange center, or at a public place with no direct contact between the parents. In a criminal case, the court can name a go-between for family matters. If your order does not say how exchanges work, ask the court before the first one rather than improvising.

Does a protective order decide custody in Utah?

Only temporarily. Custody and parent-time terms in a cohabitant abuse order are civil provisions that expire 150 days after the order is entered unless the court extends them. Permanent custody, parent-time, and child support come from a divorce, custody, or parentage case. Where both cases exist, that court can change the protective order's custody terms by agreement or for good cause.
